Dear All,
I am filing AOS for my wife. I noticed G-325A is only single page now, I remember when I submitted mine it was 5 pages. Is it changed to 1 page only or I need to make 5 copies of that single page.
I am submitting AOS and EAD, according to my understanding only 2 photo for AOS and 2 photo for EAD, total 4 photos are required. I saw in some forum they are saying about 6 photos. Am I missing anything...
Thanks
sounak
No --- as far as I know 2 for EAD and 2 for AP -- don't trust forums always go by the instructions forms e.g instructions for EAD which can be found at USCIS.gov website

You will have to redo your LC, I 140 and I 485. But you can port your priority date from the earlier application.

Every time I call USCIS to inquire if my I-140 is filled under EB2 or EB3. They ask me to ask my lawyer or employer to call. They won't tell me. I do have a copy of I-140 that states it is Eb2 (Advance degree and all) but I am concerned about what is there in USCIS system.
I cannot ask my previous enployer to call as I have left the company using AC21.
Please advise what is the solution?

I'll give you a honest answer. Consult an attorney and find a fool proof step, if there is one. Although, I'm inclined to say, stay F1 and bring her as F4. You need much more than that.
It is a big step in life, Congratulations! Whatever you do, immigration is the last thing that must be on your mind on the best day of life!

You are good till the end of your original H1 regardless of the outcome of the extension... the catch is, you have to maintain H1 status.. meaning get paid, no benching etc.,

1. March 31 , 2008 - I am on H4 with I-94=12345..
2. June 27,2008 - H1 got approved with i-94=12345.. valid from 10/1/2008-9/23/2011.
3. Sep 10, 2008 - I enter US on h4 with i-94=abcdef.....
4. Oct 1 , 2008 - Ideally (as confirmed by USCIS, immigration lawyer) , I-94=12345.. should have been in system (become active) and status changed to H1.
But it didn't happen and I-94=abcdef... is active.
Questions:
1. What is my status from Oct 1, 2008 - Dec 31, 2008? H1 or H4.
Since my h1 status was not in system, i didn't get any SSN & hence no paystubs.
2. What is the safest & quickest way to get my h1 status active in system..
a) Stamping in Canada - Quickest for me. Is it safe ?
b) Get status changed without getting out of country? - But how?
c) Stamping from Home country? -- Last option.
Any help will be appreciated.
Thanks,
AG

Hello,
Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.
Thanks,
MTRs can take months or years. There is no 60-day processing time. The prior poster's answer of a few years is not unusual.

I tried to find answers in other forums but didn't find any.
I would appreciate if any attorneys/knowledge people can help me with this
Doing a AR11/Change of address, do I include all these as additional applications
1. MTR number
2. Appeal number
3. Original 485 (denied) for primary applicant
4. Original 485 (denied) for spouse
5. Denied 140 number
or just these
1. MTR number
2. Appeal number
Also, i have a pending date-error request with my H1B and H4 extensions, do i include the H1B and H4 numbers as well.
This is getting complicated and i have just 2 more days before the 10days rule for filing AR11.
Anybody who had a pending appeal during a change of address, please reply.
thanks in appreciation

Here is copy of email from ALIPAC.
Can we try SKIL bill.
Friends of ALIPAC, The usual suspects like Lindsay Graham, Ted Kennedy, and John Kyl are pushing to add the Dream Act and other illegal alien amnesty language to unrelated bills on the Senate floor TONIGHT! We have reports of attempts to attach these measures to the war funding bill and the Homeland Security funding bill. We need everyone lighting up the DC phone lines and voice mails TONIGHT and THURSDAY, with an urgent message. "Senator _______, do NOT allow any immigration legislation to be added to other bills! We are watching and these measures have already been defeated and should not be placed into law in sneaky ways! No Dream Act! No AgJobs Amnesty Bill! Enforce our existing laws and stop Graham, Kyl, and Kennedy from sneaking Amnesty into law!" Here is the list, and please move quickly! For EB3 case, after receiving the approval for I 140, I know that we have to wait till DOL Proiority Date is current to be able to file for I485.
If we decide to receive the green card in any consulars overseas, can we just go ahead and file the I485 after getting the I140 approval? (without waiting for PD to be current)
Any advice would be appreciated?

The current form expired on 02/282009, so they might be working on revision.
I agree with you. The current form expired on 2/28 so they might post a new form tomorrow

Hi
I came to the US on H4 and then applied for H1-B. My H4 visa expired. My H1-B was approved but I was not staffed and hence not paid for the past one year and as a result I do not have pay stubs. I do not have the H1-B stamping on my passport. Now I want to apply for H4 from my home country based on my husband's H1-B.
My question is when I fill in the DS156 form what should I fill in for the following parts
1. #20 and #21 - Name and address of you current employer and Present Occupation
(Would I have to give details about the employer who filed my H1-B even though I do not have H1-B stamp on my passport)
2. #30 Have you ever been issued a US Visa - Yes/No (I do not have the H1-B stamp, I only have the previous H4 stamp)
When , Where, What Type of Visa (Would I have to mention about my H1 or H4?)
Please can anyone help me with these questions
Thanks

Thanks Members for quick response. There are few volunteers who have sent emails and are being contacted. It should be sufficient for now. In future if there is a need, I can let you know on the forum. Thanks again for your enthusiasm and continued support for IV efforts.
