I have a valid AP approved on Oct 13, 2007. The H1B visa stamped on my passport expired in Mar 2007. I have a valid one year H1B approval till Mar 2008. I do not have the original I797 approval notice but have a scanned copy of it. Now if I have to travel out of country in July and enter back on AP will there be any trouble at the POE with not having the original approval notice of last H1B.

Can the core group let us know what are they targeting right now? Are they targeting CIR next month? The lack of direction will really lead to less contribution. Without that,I will have a hard time convincing other friends about IV.

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

Hi,
I was wondering if there is a limit on the # of travels for each AP approval. I received 2 AP documents valid until May 2010. I have already travelled twice. On my first return the immigration officer kept my AP document at POE (NY) but the 2nd time it was stamped & returned (Washington DC was POE) to me. I was wondering if I could use this document for subsequent re-entries or do I have to apply for a new AP.

It is my guess that USCIS will take the finger printing records that they have in file when we filed 485 and approve the future EAD's.
I am on the same boat. I applied on May 9, recd a receipt dated May 11 and no additional info after that.

Hi all,
My wife is on F-1 Visa and is planning to graduate in Dec 07. I have applied for I-485 for both of us in last week of July. Can she Under-Enroll for Fall 2007 as that will be her graduating semester?
I understand that once I-485 is filed, the F-1 Visa candidate cannot make any F-1 related changed (transfer, extend, OPT) since that person has shown immigration intent. What about under enrollment in graduating semester? My wife called her school and they said that they have to internally approve her under enrollment by looking at her Plan of Study, graduation application etc.. The approval is given internally and INS is not involved in the approval process. It�s just that after the approval, the school has to inform INS about what they did.
Does it mean, it�s Okay to under enroll? Any inputs on this will be appreciated.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. The US Department of State has released the new Visa Bulletin (http://travel.state.gov/visa/frvi/bulletin/bulletin_4575.html) for October 2009. In family-based categories, there is very slight movement forward, but just by a few weeks or months in most categories. However, Family 1st Preference for Mexico moves forward by 17 months

This may be the Visa Office being conservative in its first allocation of numbers for the new fiscal year. Let's hope so, and hope that they move forward in the next few months.

The idea is to get a rough number or percentage of people stuck in this boat in the IV community. This would help to start a proposal for a small fix (either admin or legislative) to be passed on to be included as an item in IV's agenda. Believe there are many families stuck in the EB2 of retrogressed countries and many more in all of Eb3 categories who can benefit from a such an initiative.
Here are the options in the Poll:
1. Married; I-485 Filed for everyone in the family at the same time.
2. Married; I-485 filed separately for spouse/ dependent at a later date.
3. Married; yet to file I-485 for spouse/ dependent.
4. Single; yet to get married but filed for 485.

the fact that you move using AC21 and use EAD for work nullifies your H1 immediately and the dependents lose H4. even the date on I-94 becomes meaningless.
you will have to renew your EAD for work and AP for travel.
The fact that your I-485 is pending is all that is needed to keep you legal. But if for any reason I-485 is denied you will be out-of-status.

look at the vfs website (you will get a link to it from consulate website). They have specified some particular HDFC branches in metros, where you can deposit the fee to get the receipt.
