If you believe in law suit you can discuss with a lawyer and ask about feasiblity of lawsuit and pros and cons with potential expense. Most lawyers will not charge for initial consultation. That will be a good initiative.

Even I was wondering same thing- Notice Date or Received Date. USCIS website says Received date is taken into account while looking at service centers processing times.
Here is exact line-
"IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance."
Of course, I personally wish that Notice Date takes precedence as it is not our fault that one file just kept on sitting and in saga of moving dates and PD, each day makes a difference.
Of course it is not your fault if your case was sitting upopened for months (mine was one of them too), but as a typical govt office, Texas Service Center would also say, they are not responsible until file physically came to them, and then opened it. They treat the date you see online as "...your case was received on...", as the receive date, which is quite close to ND (no matter what is on your receipt).
If RD and and ND are too far apart, and your PD is current, but your case is not yet processed, Infopass might help, as the officer might request to move your case up. No harm in giving a try.

If the authorities were really clever they should have accepted the 65000 with highest salaries instead of doing something random like a lottery. This in turn would have forced employers to raise wages to have a meaningful shot at getting a visa.

I tend to agree.... nowhere in the past discussions IV seem to have cared about EB3s. It is more frustrating to see this situation sincce Eb3's have been suffering for longer with no hopes what so ever.
And anyone trying to implicate that EB3s are less skilled are plain wrong - we got in EB3 limbo due to large corporations doing things by book (or for plain long term commitment out of workers).
Either way, IV leadership needs to re-iterate and re-emphasize at least once that this is not EB2 fight only but EB fight in general. IV discussions simply have gone EB2 biased only for too long.

My 140 LUD is 08/05/2007 and was approved from SRC. I agree with EB3_Nepa on this. My guess is that recent updates in the LUD means that 485 is filed in the service center that did NOT process your 140.

Hi,
this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

F1 is not a scam. its legal visa. once u enter into usa on F1, u can stay here to study. while doing MS, u can also work on CPT legally. after completion of the MS degree, it is legal to stay on OPT and work. recently the US govt has increased the OPT period from 12 to 29 months. again its legal. its legal to apply for H1B while maintaining a proper F1 status or OPT.
People who dont like this.... dont either because they dont understand F1 very well, or just plainly speaking jealous or out of their mind.
i guess we should be happy if someone is making progress legally even if we are not in the same boat.:)

Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.
It si not teh question of liek or unliking or having jealousy. It is the question of law. According to the US law employee sponsership is EB category so any new bill which has to be introduced will have to follow the EB category employee sponsership rule, othwer wise it wil not see the light of the day

I have filed for H1B under the Masters quota but i will be graduating only in May and gave an official document from my University that i would be graduating. Somebody i know had also done a similar thing but he got a h1B rejection mail from USCIS yesterday. This has made me really upset. Is anyone there who has filed with a similar document and has received H1B? He had filed it witha consultant while mine is a highly reputed company. Will that make a difference?
Can you tell exact wording you used in the letter of completion. I would assume that you need to have following statement in the letter.
"xxxxx has completed all the degree requirements"
instead of just having "would be graduating"
