its unbelievable what attitude some have on here...many on here are anti-illegal immigration which is understandable...but how can you condone such inhumane treatment...we are not animals...illegals are economic refugees in a way

It is unfair to say that many EB3 and EB2 folks are stuck in GC queue for more than 10 years, FOR NO FAULT OF THEIRS. Yes, they are stuck but there is fault, in most cases, they knew they were risking it by changing employers for petty raises or other reason. If they followed the original H1B rule and stayed with sponsoring employer, GC for EB3 took a max of 7 years even with the old system of RIR (not PERM) or even without RIR - and that is MAX....very rare.
If your statements are true why are the dates backloged and EB3 stuck at April 2002? Employment based greencards should be given preference than others for several reasons:
1. Getting into US legally
2. Living legally
3. Got into US on invitation by the employer (I am talking about the most genuine cases)
4. Intention was dual (to work in US and there by immigrate)
5. Generating revenue to the govt by paying taxes
If the employers have not offered to apply for permanent residency people would have not had any intentions of staying back in US and to buy houses. They would have worked for allocated period of time and have gone back to home country like they do in most of the European countries.

From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.

Cost of attending the meetings with lawmakers and seeing every IVian, that attended the event during the last three days, working relentlessly for the entire immigrant community stuck in the huge greencard backlog : PRICELESS PRICELESS PRICELESS :)
I think, the event was a huge success and the outcome of the meetings were positive. I wish at least one representative from each state participated in the event. Some offices insisted that they talk to their constituents.

If he was approved this month, it must have been based on the August Visa bulletin. If so the priority date for EB-2 is not current for this guy (per bulletin it is 01OCT03). Also his 485 application date is eight months away from the current processing date.

Well having attorney will help AC21 cases also. Who knows how limited knowledge has regarding AC21 and all the latest memo associated with it. Even if they have some knowledge they may try to impose a different interpretation of that on you during the interview.

As I had mentioned earlier, do not be under the misconception that just because you are working in a stable cash-rich comany and happy with your job, it can't get bad. Your company can move, downsize, close a branch or just fire you....given the current scenario, it will take atleast 5/6 years (if you are lucky and maybe more if you are unfortunate) to get a GC and all these years can go waste by any of the above happening

My GC process was started in 2001, my labor was approved in 2003 but since my company was closing the branch office where I worked, I had to move to the main office which was in a different state. Due to this my approved labor went down the drain. I moved to the state of the head office, meanwhile my company off-shored a major portion of the development office where I was working early 2005. After much persuasion from me the filed again but I had to either move offshore or take up a 90% travel job with the same company. Now, I travel and am away from my family during the weekdays. I have lived in USA for 6 years - legally paying my taxes, following all the laws and contributing to the society to the best of my abilities. I am currently on H1-B visa extension.
My wife is working for a company on H1-B. Her employer promised in mid-2005 that she would start the GC process for her so that we could have a backup. Till now her GC has not been started. My wife is in a dilemma of whether she should quit her job and join somewhere else. But if she does move to a new company, even they will not start her GC process immediately. Even if they do what is the point because of retrogression?

I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though
18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo
19) I went back an hour later with the print out
20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in
22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)
23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
then she asked, I am sure you didnt come back for I-94 alone, did you get any document?
24) We showed her the memo.
25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today
26) We waited for 2 hrs and then she took us inside.
27) Asked our passports (to stamp...really)
28) Then she looked into the computer to get the visa #.
29) The we noticed a changed in her face and then she quickly turned into a folder of current VISA bulletin..we said..oh..no..not again.
30) The officer said, per visa bulletin u r current and ur PD is dec 2005..there is no reason for system not to allocated a visa #..
31)She tried for 10-15 mins and finally gave up..said she cant stamp in the passport without allotting the visa number..said sorry..I cant do anything..I will follow up with DOS ppl and will let you know in a week or so.

This interview EXPOSED how un-informed and careless and whimsical are IOs in handling cases. MEMO should have been framed on their desks/mind....we don't have to remind these guys. In one moment they can deny as important a petition as AOS and just in a flash second they can approve it. They won't make any effort to dig out relevant info. It is like fliping a coin...plain luck when it comes to GC.

This interview EXPOSED how un-informed and careless and whimsical are IOs in handling cases. MEMO should have been framed on their desks/mind....we don't have to remind these guys. In one moment they can deny as important a petition as AOS and just in a flash second they can approve it. They won't make any effort to dig out relevant info. It is like fliping a coin...plain luck when it comes to GC.

I'll just shut up after this post now. You are obviously incapable of understanding my argument.
I'll continue to assume that IV is working for the interests of all EB based applicants, and not just those belonging to one particular country, especially at the expense of EB3-ROW. And I am pretty confident that the core and the majority of the members of this forum have enough integrity to let people like me know I am mistaken in this belief.
I do not care whether you contribute to IV or not. What I am writing here is law or facts and how it is affecting oversubscribed countries becuse of wrong interpretation of law. I am not here to unite or divide any group. In my level, I am contributing to end retrogression by sending mails to law makers. Even any law passes to remove retro, this misinterpretation of law is screwing Indians and Chinese. A EB2 person from Iran/Iraq/Pakistan with PD 2007 can get GC with in 6 months (right from PERM labor to 485 approval) why should Indian with PD in 2003 has to wait for ever?
My employer hired me not based on citizenship. They hired me based on their requirement for the job and my skills. They do not care, if I am male or female or Indian or Chinese or Iranian or Iraqi or Pakistani or European. I am penalized for just I am Indian not able to adjust LPR even I have priority date in 2003 after a long wait for Labor certification and 140 approvals. However, if I am from other than India and China I would have got GC with in six months even if my PD in late 2006. If a person with a Priority Date 2007 can become LPR immediately in EB2 category even if he is from a state sponsoring terrorism (provided if his background check is cleared). However a person from India having priority date in 2003 can not become LPR and sitting in dark to hope to see the light at the end of tunnel. How fare it is? Is it not the discrimination by country of birth?

Thanks. Fortunately I have my I-485 approved more than a year ago and it was adjudicated and approved in one go.
